Complete Agreement
Gull Group Inc., D/B/A Seasonal Specialty Stores, agrees to provide to the customer named on the Personal Pool Calendar, the following products and services:
- Personal Pool Calendar.
A summary of normal pool care, according to our knowledge of local conditions, and the specific information given to us by the customer. Chemical advice is based on local Board of Health regulations, plus recommendations by Biolab Inc., and Zeneca Inc. pool water research laboratories. This is only a summary, and the customer is also provided with our own "Pool Tips" publications, plus pool care guides published by Bioguard® and Baquacil®.
- Take It Easy Hotline.
An unlisted telephone line, available from April until September, for the use of Take It Easy customers. We cannot guarantee that the number will never be busy, but it will always be much less busy than the main line. This year's number is on the upper left corner of the Personal Pool Calendar, and the number will be changed next year.
- Algae-Free Guarantee.
If any algae growth (green, blue-green, black, mustard algae) develops in the customer's pool at least a month after joining the Take It Easy Program, we will advise you on how to kill it, and we will mail you a merchandise credit for the normal value of chemicals required, above what you would normally have put in anyway.
- Bioslime Guarantee (Premium Program only)If any bioslime growth (pink, clear, red slime or grey or white water mold) develops in the customer's pool at least a month after joining the Take It Easy Program we will advise you how to kill it, and we will mail you a merchandise credit for the normal value of chemicals required, above what you would have put in anyway. Bioslime claims will not be processed without proof that you have actually followed the Premium Program, and they cover the initial killing treatmentnot continuing maintenance.
- Clear Water Guarantee.
If a chronic cloudy water problem develops in the customer's pool, at least a month after joining the Take It Easy Program, and it does not respond to normal initial treatment (120 hours of constant filtration, with circulation and filter media improvements), we will mail you a merchandise credit for an initial treatment of Target Super Kleer or Sea Klear Clarifier. Subsequent treatments of that, or any other clarity or filter aid products may be purchased at 50% off the original retail price, including rental of our DE80 or NS48 Service filters.
- Free Winter Kit.
The Take It Easy envelope will include a certificate for our own brand winter chemical kit, that you may redeem in August or September. You must present the certificate in order to receive your free kit.
In order to qualify for the services described above, the customer must maintain the following:
- Minimum Chemical Standards.
- Have pool water analyzed three times a year by a major water lab and computer program (preferably ours), and balance to a Langlier Saturation Index of -0.3 to +0.3.
- Maintain a consistent 3-step chemical program of sanitizer, shock, and algaecide; as described on the Calendar.
- Test regularly, and maintain the shock and sanitizer level consistently within the recommended amounts.
- Use the Personal Pool Calendar only as a summary; learn all of the information in Pool Tips and the Pool Guides.
- Minimum Filtration/Circulation Standards.
- Filter pool water at least 8-12 hours per day, with a filter system appropriate for the pool.
- Clean all baskets and brush walls at least once a week.
- During periods of heavy use or heavy rain, increase filtration up to 24 hours a day.
- If pool starts to become cloudy, increase filtration, improve circulation, and ask us for advice.
- Sand filters must receive new sand each year plus a chemical cleaning, or chemical cleaning twice a year. D.E. and cartridge filters must have a chemical cleaning twice a year.
- Minimum Purchase Requirements.
- Once you have chosen a chemical system and brand from the following, the majority of the chemicals used in the pool must be from the same brand (unless we approve a variance): Target, Baquacil®, Bioguard®, or Softswim®. Under some circumstances, New Water cartridges, Seasonal Nature2 cartridges and Eco Spring cartridges will be allowed with the Target system.
- You need not purchase all of your pool chemicals from us, but we expect at least 50% of your normal usage to be from us.
- Save your receipts. They need not be itemized, but we reserve the right to review all of your chemical purchases if you wish to make use of the algae-free, Bioslime or clear water guarantee. We will accept as proof that you followed the minimum standards and requirements, your register receipts that you purchased the correct products in the required amounts and your statement on the claim form. Bioslime claims will be checked very carefully. You do not have to make any purchases or minimums at all, to make use of the calendar, phone number, or winter kit.
- Cancellation
Both parties may cancel this agreement at any time, and with no notice. If the customer cancels, we will provide a full refund of the registration fee when the customer returns the winter kit certificate or unused kit. If we cancel, we will provide a full refund of the registration fee, and the customer may retain the winter kit certificate or the winter kit.
